The European Commission is running a public consultation until 16 November on a draft delegated Regulation ‘amending Regulation (EU) No 649/2012 of the European Parliament and of the Council as regards the listing of pesticides, industrial chemicals, persistent organic pollutants and mercury and an update of customs codes’ that would add substances recently banned by the Stockholm Convention or in Europe (eg perfluorooctanoic acid (PFOA), as well as several pollutants and mercury products, to Annex V) to the prior informed consent (PIC) Regulation 649/2012, thus banning their export and products containing them.

Substances proposed for:
- Annex I: substances subject to export restrictions : ao
- bis(pentabromophenyl) ether (decaBDE);
- benzene, as a constituent of other substances;
- lead, in the subcategory ‘industrial chemical for public use’;
- mercury; and
- cadmium and its compounds
- Annex V: substances that cannot be exported
- PFOA & related compounds (FFF)
- PFOS (not for mist surppressants)
- the disinfectant and pesticide pentachlorophenol and its salts and esters;
- mercury, certain mixtures with other substances, compounds and mercury-added products, to reflect the existing export ban under a 2017 EU Regulation; and
- difocol, a pesticide
